INTERNAL REPORTING CHANNEL
Companies with more than 249 employees and public employers are obliged to set up a reporting office through which whistleblowers can report violations of the law. The information must be able to be given both in writing and orally. To companies with 50 or more employees, the HinSchG applies from December 17, 2023.
ANONYMOUS AND CONFIDENTIAL
The identity of the whistleblower and the persons or group of persons who are the subject of the report must be protected.
GUIDELINES FOR THE PROCESSING PROCEDURE
The processing of a notification follows the legal requirements:
- Confirmation of notification receipt after seven days at the latest
- Verification of the report
- Ensuring the possibility of continuous anonymous communication
- Taking appropriate measures regarding the content of the report
- Feedback from the person processing the report to the whistleblower within three months
COMPETENT AND INDEPENDENT
The person who receives notices for the company requires legal expertise and has to be independent. He or she must not have any conflict of interest with any other task in the company that he or she is engaged to perform. In addition, the person appointed must regularly attend specialist training courses.
